LanguageMate (provided by LanguageMate LTD®️ with company number: 11657361, registered in England and Wales) is a digital platform designed to enhance your language learning journey through engaging conversations. By accessing or using our platform, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully. Our LanguageMate services include a conversational platform, designed to facilitate language practice, on an application available to download on mobile and/or tablet devices (“Apps”) and through our website https://www.languagemate.io (“Website”). Access to our scenarios and courses, is our service to you (“Services”). In order to access our Services, whether or not you are an existing or former user, you confirm that you have read these Terms and Conditions of Use (“Terms”). Whenever you use our Services, you acknowledge that you understand and agree to these Terms, and you also agree to our Privacy and Cookie Policies. We may occasionally make changes to our Terms. Your continued use of our Services after any amendments constitutes your acceptance of any such amendments. The updated Terms can be found at https://languagemate.io/terms. If you do not agree to comply with these Terms, please do not register to use, access or continue to use our Services. We may terminate your access to the Services if you breach our Terms in accordance with clause 11 below.

  1. Acceptance of Terms By accessing or using LanguageMate, you agree to be bound by these Terms and Conditions (T&Cs), our Privacy Policy, and any other conditions and policies referenced herein. You confirm: (i) you are at least 18 years old or have obtained informed consent of your parent or legal guardian (who will take responsibility for your compliance with these Terms); and (ii) your use of the Services will not violate the below Clauses or any applicable law or regulation in the province state, territory, or country in which you reside.
  2. Description of Service LanguageMate offers AI-driven language learning scenarios that incorporate real-world conversational settings to users worldwide. Our services include, but are not limited to, interactive scenarios and immediate personalised feedback.
  3. User Accounts
    1. Creation To access the features of the platform, you must create an account. You agree to provide accurate, complete, and up-to-date information.
    2. User Responsibility You are responsible for all activities that occur under your account. You must keep your password confidential and notify us immediately of any unauthorised use of your account.
    3. Minors' Accounts If you are under 18, your parent or guardian must review and consent to our T&Cs on your behalf.
    4. Institutional Consent In an institutional setting, such as a school, university, or training programme, an authorised individual (such as a teacher, administrator, or other designated representative) may consent to these terms and conditions on behalf of students or participants if they are authorised to do so. By providing consent, the authorised individual affirms that they have the authority to act on behalf of the students or participants and that the students or participants are aware of and agree to comply with these terms and conditions.
  4. Privacy Policy We take your privacy very seriously. Any personal information you submit to us when setting up an Account shall be subject to our Privacy Policy which is incorporated into these Terms. You understand that through your use of the Services, you consent to the collection and use (to the extent stated in the Privacy Policy) of this information.
  5. Intellectual Property Rights All content on LanguageMate, including texts, graphics, logos, and software, is the property of LanguageMate or its content suppliers and is protected by the laws of England and Wales and international copyright laws. Our name ‘LanguageMate’ is our registered trademark mark. You are granted no general right or commercial license with respect to our trademarks, service marks and logos.
  6. Licence to Use LanguageMate grants you a limited, non-exclusive, non-transferable licence to access and use the platform and its content for your personal, non-commercial educational purposes, subject to our T&Cs.
  7. Restrictions on Use You may not: Use the platform for any unlawful purpose. Resell or redistribute the service or any part of it. Use the platform to collect personally identifiable information of other users.
  8. Content and Conduct You must not use LanguageMate to send, upload, or distribute any material that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by LanguageMate. You agree not to spam or send unsolicited messages. You must not attempt to gain unauthorised access to our servers or networks connected to LanguageMate.
  9. Nature of AI-Generated Content
    1. LanguageMate leverages Artificial Intelligence (AI) technologies to generate content and facilitate language learning through conversational real-world scenarios. Users acknowledge that AI-generated content, including responses, conversations, and other materials, is created automatically without human review before being provided to the user.
    2. To the fullest extent permitted by applicable law, LanguageMate does not assume any liability or responsibility for the accuracy, completeness, reliability, appropriateness, or legality of any AI-generated content provided on LanguageMate. The content is provided "as is" and "as available".
    3. Users should exercise discretion while interacting with AI-generated content on LanguageMate. The content is intended for educational purposes to teach conversational skills in a foreign language only and should not be relied upon as advice or construed as providing recommendations of any kind.
  10. Deleting your Account You can delete your account and terminate your use of the Services at any time by locating the ‘delete profile’ option in the settings section of your Profile. Once you have deleted your Account, your Licence will be revoked and you will no longer have access to your Profile.
  11. Termination LanguageMate reserves the right to terminate or suspend your account and access to the services for any breach of our T&Cs.
  12. Disclaimers of Warranties LanguageMate is provided "as is" and without warranty of any kind, either express or implied. While we strive to provide a valuable service, we do not warrant that the services will meet your requirements or that the operation of the services will be uninterrupted or error-free.
  13. Limitation of Liability LanguageMate will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of or inability to use the platform.
  14. Indemnity You agree to indemnify and hold us, our officers, employees, contractors, suppliers, affiliates, agents and licensors harmless from any losses, damages, cost, expense (including reasonable legal fees) or other liability, arising out of any claim, demand, allegation or proceeding brought by any third party due to, or arising out of your User Content, your use of the Services, your connection to the Services, your breach of the Terms, or your violation of any rights of another person or entity.
  15. Governing Law Our T&Cs are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
  16. Changes to Terms LanguageMate reserves the right to change our T&Cs at any time. Your continued use of the service after any changes indicates your acceptance of the new T&Cs.
  17. Reporting Violation of Terms Please report any suspected or known violations of these Terms here contact us stating “Violations of Terms”. If you wish to notify us about any suspected copyright infringement of any third party, please contact us via the same contact form stating, “Copyright Notification”.
  18. Payment and Fees Payments for our services are due within 30 days of a contract being signed and are due in advance of the services being performed. The specific terms related to subscription and payment will be provided within the final purchase contract. Failure to pay any fees may result in suspension or termination of your access to the Services.
  19. Force Majeure LanguageMate shall not be liable for any failure to perform its obligations under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, or other natural or man-made disasters.
  20. Governing Law and Jurisdiction Our T&Cs are governed by the laws of England and Wales. Any disputes arising out of or in connection with our T&Cs shall be subject to the exclusive jurisdiction of the courts of England and Wales.
